JAMMU : The Government of Jammu and Kashmir has enhanced the age of superannuation of Judicial Officers serving in the Union Territory from 60 to 62 years.
As per *Government Order No. 12440-JK(LD) of 2026 dated 05-10-2026* issued by the Department of Law, Justice and Parliamentary Affairs, the decision follows directions of the Hon’ble Supreme Court in W.P.(C) No. 1022/1989 titled _All India Judges Association & Ors._
The Supreme Court, vide orders dated 22-07-2026 and 05-08-2026, had directed State Governments/UTs to take a decision regarding enhancement of retirement age from 60 to 61/62 years in consultation with the respective High Courts, and that wherever such enhancement is agreed to, it shall take effect from *31-03-2026*, including in respect of Judicial Officers who retired on or after the said date, subject to their consent.
In pursuance of the directions, the matter was considered in consultation with the Hon’ble High Court of Jammu and Kashmir and Ladakh. The Registrar General, vide communications dated 30-07-2026 and 12-08-2026, conveyed that the Hon’ble Full Court in its deliberations held on 10-08-2026, resolved to recommend enhancement of retirement age of Judicial Officers in the UTs of Jammu & Kashmir and Ladakh to 62 years, subject to such officers being found fit and eligible for their continued utility beyond 60 years.
The Finance Department vide U.O No. 7786054 FD-Code/916/2026-02-978 dated 09-09-2026 conveyed its concurrence. The Council of Ministers, vide Decision No. 146/12/2026 dated 22-09-2026, has accorded approval to the proposal.
Accordingly, the Competent Authority has accorded sanction to enhancement of superannuation age from 60 to 62 years w.e.f 31-03-2026 subject to conditions:
*(i)* Continuation beyond 60 years shall be subject to assessment by the Hon’ble High Court of Jammu and Kashmir and Ladakh of fitness, eligibility, suitability, performance and continued utility of the Judicial Officer.
*(ii)* Necessary amendments in the relevant rules shall be undertaken in consultation with the High Court.
The order has been issued by order of the Lieutenant Governor and signed by Achal Sethi, Commissioner Secretary to the Government.
